Metairie Louisiana V. Guillot's Fraud Case
COMPLAINT On April 14, 2015, Brian F. Guillot, Esq., of Metairie Louisiana, submitted a complaint to Office of the Bar Counsel regarding Ernest A. Solomon. Guillot asserts that Solomon failed to comply with Guillot's request for accounting in reference to the estate of Elmore C. Desvigne, Sr. Solomon has allegedly violated Mass.R.Prof.C 1.15(c) and (d). FACTS On April 15, 2015, Brian F. Guillot, Esq., of Metairie Louisiana, contacted Office of the Bar Counsel regarding Solomon's failure to account for $17,000 that had been delivered to Solomon by Janet Desvigne, before he had been confirmed as the executor of Elmore Desvigne's estate. Ms. Desvigne was Elmore's daughter–in–law, and had been appointed as his power of attorney on July 6, 2012. ... Show more content on Helpwriting.net ...Solomon knowingly received and spent the $17,000 "reimbursement" which came from Elmore's estate funds as evidenced by the check memo which states"Elmore Desvigne Estate." It is unclear why Solomon would front the money In April from his IOLTA, and then deposit the "reimbursement" into his business account. On October 9, 2015, a subpoena was sent by Office of the Bar Counsel to JP Morgan Chase to officially determine who the mortgagor is for Chase Home Finance Loan number 1991796965. Additionally, Solomon has until October 23, 2015, to respond to bar counsel's inquiry regarding his cash deposit of $16,860. Based on the evidence already obtained, bar counsel believes there is sufficient evidence to file a Petition for Discipline. RESPONDENT'S HISTORY WITH OFFICE OF BAR COUNSEL On July 25, 2014, Justice Cordy with the Supreme Judicial Court entered an Order of Term Suspension for Solomon; the suspension is for a term of fifteen months. Solomon currently has three pending cases, six disposed cases, and a total of fifteen ACAP calls.
